Elektrodistribucija Srbije (EDS), ogranak Šabac, sama je izgradila trofazni priključak na jednoj kući, naplatila ga, dvaput tehnički pregledala i odobrila, sama ugradila brojilo, a snabdevač potpisao ugovor. A onda je ista EDS to proglasila „neovlašćenom potrošnjom“, isključila kuću i poslala kaznu od 343.320,65 dinara. The long holidays of the guest-workers' children: a packed car, the smell of the road, the border, the thrill of arriving. The nineties and the early two-thousands, the years he felt most himself. That feeling, a life between two countries and a suitcase that never quite gets unpacked, few people in Serbia itself ever fully understand, not even those who left it over the past twenty years.

Decenijama radi i gradi život u inostranstvu, ali korene nikad nije zaboravio. Mogao je da uloži bilo gde: tamo gde živi, bilo gde u svetu. He returned to his roots and built a house in the Šabac region, to invest where he came from and leave something to his homeland.

Nije „dve službe koje se nisu čule“. Ista firma, ista godina. Svaki potez označen je istim pečatom. This is not “two departments that didn’t talk.” The same firm, the same year. Every step bears the same stamp.

Postoji pravno načelo staro koliko i pravo samo: ko nešto sam učini, ne može se posle žaliti da je to učinio neko drugi. Na latinskom se zove venire contra factum proprium. Na srpskom je još jednostavnije: ne možeš da se buniš na sopstveni rad. There is a legal principle as old as law itself: you cannot do something yourself and then complain that someone else did it. In Latin it is called venire contra factum proprium. In plain words: you can’t object to your own work.

Ima i bonus-paradoks. U EDS-ovoj evidenciji staro brojilo, ono koje je njihova ekipa lično skinula, i dalje se vodi kao „aktivno“. Trči-begaj po šalterima From counter to counter

Žalba je poslata, sve do vrha, do Predsednika Republike. Evo kako je putovala: svaka stanica je bila ili „nenadležna“, ili je ćutala, ili je predmet vraćala onome ko je kaznu i izdao. A complaint was filed, all the way to the top, to the President of the Republic. Here is how it travelled: every station was either “not competent,” or silent, or sent the case back to whoever issued the fine.

  1. Žalba ide čak do Kabineta Predsednika Republike → predmet je prosleđen nazad istom preduzeću koje je kaznu i izdalo, uz zahtev da se „izjasni i izvesti“ o sopstvenom slučaju.The complaint goes all the way up to the Office of the President of the Republic → the case is forwarded back to the very company that issued the fine, with a request that it “respond and report back” on its own case.
  2. EPS (jedini koji je sadržinski odgovorio): prosleđeno EDS-u, ogranak Šabac, istom onom koji je i izdao kaznu, uz upućivanje na sajt za vansudsko rešavanje sporova.EPS (the only one to actually engage): forwarded to EDS, Šabac branch, the very office that issued the fine, and pointed to a website for out-of-court dispute resolution.

Više od 25 obraćanja i podnesaka. Jedan stvarni odgovor. Sve ostalo je upalo u istu crnu rupu: svaka nadležnost uredno raspoređena, nijedna iskorišćena. More than 25 submissions and appeals. One real reply. Everything else fell into the same black hole: every jurisdiction neatly assigned, not one of them used.

A onda, u pisanom odgovoru, snabdevač sve i sam priznaje: izdavanje odobrenja za priključenje, određivanje tehničkih uslova i samo „utvrđivanje i obračun nelegalne potrošnje“, sve to spada isključivo u nadležnost distributera. Drugim rečima: kaznu je mogao da napiše samo onaj isti EDS koji je taj trofazni priključak i izgradio, naplatio, pregledao i očitavao. Then, in a written reply, the supplier admits it itself: issuing the connection approval, setting the technical conditions, and the very “determination and calculation of unauthorized consumption” fall solely within the distributor’s remit. In other words: only that same EDS, the one that built the three-phase connection, charged for it, inspected it and read the meter, could have written the fine.

Sedam godina uredno plaća. Čim zatreba odgovor, niko nije nadležan. Samo u Srbiji. Seven years of paying on time. The moment an answer is needed, no one is in charge. Only in Serbia.

Kome se onda žaliti? So who do you complain to?

Probali smo sve, od Kabineta Predsednika Republike do inspekcija. Kabinet je predmet prosledio nazad istom preduzeću koje je kaznu izdalo, uz zahtev da izvesti o sopstvenom slučaju. I EPS je predmet vratio EDS-u, uz link ka jednom sajtu. Regulator i Zaštitnik građana: „nismo nadležni“, odnosno „preuranjeno“. Inspekcija: tišina. Svaki šalter ili ćuti, ili vraća, ili upućuje na sledeći. Dobro došli u proceduru.We tried everything, from the Office of the President of the Republic down to the inspectorates. The President’s office forwarded the case back to the very company that issued the fine, asking it to report on its own case. EPS, too, returned the case to EDS, with a link to a website. The regulator and the Ombudsman: “not our jurisdiction,” or “premature.” The inspectorate: silence. Every counter either goes quiet, sends it back, or points to the next one. Welcome to the procedure.

Ovo nije priča po sećanju. A man who returned to his roots and invested in his homeland, then spent months calling, writing and waiting at counters. The power was cut in March. The counter at the top of this page is not a joke, it counts real days without electricity. And above it all hangs the possibility of forced collection, even against the house itself.

Nemoguće stvari današnje Srbije The impossibilities of Serbia today

Ovaj slučaj nije izolovan. Odvija se tamo gde je određena vrsta nemogućnosti postala uobičajena. This case is not isolated. It unfolds where a certain kind of impossibility has become routine.

Distribucija struje je praktično monopol jedne državne kompanije; spor se „rešava“ unutar iste vertikale koja je i odlučila. Pritužba vrhu izvršne vlasti redovno se vraća upravo onom ogranku na koji se i odnosi. Jedna inspekcija se proglašava nenadležnom, druga ćuti. A povratniku iz dijaspore poruka je posebno hladna: uloži, gradi, priključi se uredno, čuvaj svaki papir, i opet možeš završiti pred šalterom koji te vraća onome ko je problem napravio. Sedam godina je već postojalo monofazno brojilo, uredno i plaćeno, a korisnik je ipak zaglavljen u proceduri. Problem nije struja, problem je sistem. Electricity distribution is in practice the monopoly of a single state-owned group; the dispute is “resolved” inside the very vertical that decided it in the first place. A complaint to the top of the executive is routinely sent back to the very branch it concerns. One inspectorate declares itself not competent, another stays silent.
